    Rivers: Appeal court reserves ruling on Assembly crisis

    The Court of Appeal sitting in Port Harcourt, Rivers State capital, has reserved ruling in the suit between Martin Amaewhule and 24 others against Victor Oko-Jumbo and others.

    The appeals court resolved on Thursday to deliver its ruling at a later date.

    The three-member panel of Justice Jimi Olukayode Bada, Justice Hama Barka, and Justice Balkisu Aliyu made this decision during their sitting on appeal number CA/PHC/198/2024, which was virtually monitored on Thursday.

    Amaewhule and the other twenty-four people are contesting the interlocutory injunction of Justice Charles Wali of a State High Court in Port Harcourt, which validated the declaration of their seats in the state House of Assembly vacant while the court was sitting in Port Harcourt, the capital of Rivers State.

    In addition, until the matter at hand is resolved, Amaewhule and others were instructed by the High Court to cease representing themselves as members of the Peoples Democratic Party and the Rivers State House of Assembly.

    Amaewhule and other individuals, however, were unsatisfied with the high court’s finding and petitioned the state’s Court of Appeal for a stay of the order and its eventual invalidation.

    During its June 14 session, the court recommended the appellant serve all processes on the defendant and encouraged the parties involved in the appeal to preserve the status quo.

    In the lawsuit, Amaewhule is contesting the lower court’s jurisdiction to hear the case and is requesting a stay of the High Court’s interlocutory orders.

    However, the court decided to notify the parties of its decision about the matter at a later time.
