The Presidential Election Petitions Tribunal has ruled that the Electoral Act 2022 does not include any provision for electronic transmission of election results.
The Bimodal Voter Accreditation System (BVAS), according to the five-member panel led by Justice Haruna Tsammani, is the only technological gadget that the Independent National Electoral Commission (INEC) must utilize for the election.
Concerning noncompliance with the Electoral Act and INEC Regulations and Guidelines, Justice Tsammani stated that there is nothing in the regulation that requires the BVAS to electronically send polling unit results.
The Tribunal further ruled that the commission’s Results Viewing Portal (IReV) is not a collation system, which is supported by the decision in the case of Oyetola vs INEC.
“There is no provision in the Electoral Act 2022 for electronic transmission of election results,” Justice Tsammani explains. “At best, it is optional.”
