A witness for the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, testified that both the party’s candidate and All Progressives Congress (APC) President Bola Tinubu are ineligible to be declared president because they did not receive 25% of the vote in the Federal Capital Territory (FCT).
Under cross questioning by counsel to the Independent National Electoral Commission (INEC), Mohammed Aliyu, he stated that the 25% was a mandatory requirement for being proclaimed president.
When questioned if his comment was personal, he said that it was based on a fundamental provision.
In answer to a query on whether his candidate received the needed 25 percent of votes in the FCT, he stated, “My candidate did not receive 25 percent of votes in the FCT according to the purported result published by INEC.”
Under cross examination by Tinubu’s attorney, Akin Olujimi (SAN), he argued that his assertion was legal.
He did confess, though, that he was neither a lawyer nor a mathematician.
Under questioning from All Progressives Congress (APC) counsel Lateef Fagbemi (SAN), Madaki agreed that the FCT is like any other state.
Peter Obi, the presidential candidate of the Labour Party is the only candidate that polled 25 per cent in FCT in the February 25 election.
