The Lagos State High Court in Ikeja declared Mudashiru Obasa’s impeachment as Speaker of the Lagos State House of Assembly illegal and unconstitutional.
Justice Yetunde Pinheiro ruled on Wednesday that the House’s January proceedings and resolutions that led to Obasa’s removal were invalid.
Obasa has filed a lawsuit against the Lagos State House of Assembly and Mojisola Meranda, the newly appointed Speaker, questioning the constitutionality of the procedure that led to his expulsion.
The Speaker, through his counsel, Chief Afolabi Fashanu, claimed that the decision to remove him was made by 36 lawmakers when the Assembly was in recess and he was out of the country.
He argued that the session was unlawful because it was called without his approval or a proper delegation of power, violating House protocols.
The complaint was filed on nine grounds, citing pertinent articles of the 1999 Constitution (as amended) and the Standing Orders of the Lagos State House of Assembly.
