Court stops implementation of new electricity tariff

A Federal High Court in Kano has granted an order preventing the National Electricity Regulatory Commission and the Kano Electricity Distribution Company from imposing the new electricity tariff on Band A customers.

Super Sack Company Limited and BBY Sacks Limited filed the lawsuit under case number FHC/KN/CS/144/2024.

Others include Mama Sannu Industries Limited, Dala Foods Nigeria Limited, Tofa Textile Limited, and the Manufacturers Association of Nigeria Limited.

However, in response to an ex-parte move filed by Abubakar Mahmoud, counsel for the plaintiffs, the presiding judge, Abdullahi Liman, directed NERC and KEDCO to postpone the imminent tariff until the hearing and resolution of the motion on notice brought before it.

The order also prohibited the defendant from harassing the applicants or threatening to terminate their power supply if they refused to accept the newly raised pricing.

In April, NERC approved an increase in electricity tariffs for users classified as Band A.

Customers in the group who receive 20 hours of energy every day would start paying N225 per kilowatt on April 3, up from N66.

The House of Representatives and other stakeholders have subsequently criticized the unexpected increase, urging NERC to halt the implementation of the higher rate.
