The trial of former Minister of Power, Olu Agunloye, continued on Thursday at the Federal Capital Territory High Court in Apo, Abuja, with a prosecution witness affirming that two key EFCC exhibits presented in court are identical in content.

Agunloye is being prosecuted by the Economic and Financial Crimes Commission (EFCC) on an amended seven-count charge bordering on alleged official corruption and the fraudulent award of the 3,960MW Mambilla Hydro-Electric Power Project contract to Sunrise Power Transmission Company Limited, valued at $6 billion.

According to the EFCC, the fifth prosecution witness, Iliya John Iyakwari, concluded his re-examination before Justice Jude Onwuegbuzie. Iyakwari, a former Assistant Director (Legal) at the Federal Ministry of Justice who now serves as an Assistant Legal Adviser in the Federal Ministry of Power, told the court that Exhibits EFCC 3D and EFCC 3K contained the same extracts from the minutes of the Federal Executive Council meeting of May 21, 2003.

He stated that both documents were identical and contained the same deliberations, resolutions, conclusions and directives relating to the Mambilla Hydro-Electric Power Project contract.

During the proceedings, prosecution counsel Abba Muhammed (SAN) reminded the court that during cross-examination on June 18, 2026, defence counsel Adeola Adedipe (SAN) had shown the witness the two exhibits and asked him to compare them. At the time, the witness had said Exhibit EFCC 3D was not known to him.

However, during the re-examination, the prosecution asked the witness to review both documents again and confirm whether the contents were the same. Iyakwari told the court that the two exhibits were identical and verbatim in their presentation of the FEC meeting’s deliberations and decisions.

Following the witness’s testimony, Justice Jude Onwuegbuzie adjourned the case until July 6, 2026, for the continuation of the trial.Mambilla project trial continues as witness tells court EFCC exhibits are identical in Agunloye’s alleged $6bn fraud case.
