The Supreme Court reversed the Court of Appeal’s decision to remove Plateau State Governor Caleb Muftwang.
On Friday, a five-member panel of justices unanimously decided that Muftwang’s appeal has substance and should be accepted.
The ruling, read by Justice Emmanuel Agim, concluded that Nentawe Yilwatda Goshwe and the APC’s petitions challenging Muftwang’s victory at the polls lacked locus standi since they were not PDP members.
The panel determined that the nomination was an internal political party affair and that the PDP followed the high court’s direction to conduct congresses.
He ruled that Muftwang was qualified to contest the election because the primary election that produced him was well conducted by the National Executive Committee (NEC) of the PDP.
“The orders of the court have nothing to do with the powers of the national executive of the party to conduct primaries,” he said.
Furthermore, he ruled that there was no evidence that the PDP disobeyed an order issued by the Plateau State High Court ordering fresh congresses for the constitution of the state executive committee of the party.
